Consumer Fraud Class Action Victory over BP

In Scharfstein v. BP West Coast Products, LLC, State of Oregon, Multnomah County Circuit Court Case No. 112-17046, David Sugerman and his co-counsel won a stunning class action victory over BP. The Oregon jury found that BP illegally charged consumers debit card fees at Oregon ARCO and ampm minimarkets over a 32 month period. BP illegally charged debit card fees on gas purchases 13,000 times every day in Oregon. The verdict allows recover of $200 per person for more than 2 million consumers. Consumes will recover $340 million based on claims made to date. An additional sum of unclaimed money–an estimated $60 million–will likely be allocated between Oregon Legal Aid and a fund to provide benefits to affected consumers. The total recovery is expected to exceed $400 million. The case is continuing.
