Oregon Army National Guard Veterans’ Victory Over KBR

Bixby v. KBR, Inc. U.S. District Court Case No. 3:09-cv-632-PK (D. Or.): On November 2, 2012, a unanimous jury found in favor of the first 12 Oregon Qarmat Ali veterans and assessed the group’s total damages at $85 million. We were pleased with this result for our veteran clients. The case was a landmark on many fronts. On appeal to the Ninth Circuit Court of Appeals, the judgment was vacated because of a change in the rules of personal jurisdiction. The case was transferred to Texas, KBR’s home court. The Texas court dismissed the case on a question of expert evidence, and the Fifth Circuit affirmed. The case was ultimately lost. We could not get justice for our Qarmat Ali veterans. As part of our work, advocacy at the VA got better health care and screening for the Qarmat Ali veterans. We also worked with members of the Oregon Congressional delegation to tighten laws on oversight of military contractors. We remain thankful to our veterans who allowed us to fight for them.
